DMCA and takedowns
Pardall Games is a non commercial archive, and it respects the rights of the owners of the games it shows. If you own the copyright of something here (or act for the owner) and want it removed, send a notice by email to pardallgames@gmail.com.
An informal request is fine too. A formal DMCA notice isn't required: if you own the content (or represent the owner), write with what you want removed and how to confirm who you are. The formal notice below is for when you want it on the record.
Where to send it
- Email: pardallgames@gmail.com
- Operator: Alfred Reinold Baudisch, Brazil
What a notice must have
A notice under the Digital Millennium Copyright Act (17 U.S.C. 512(c)(3)) needs all of these:
- The copyrighted work: what you own (the game, its models, textures or animations). A list is fine for many works.
-
The material here: the model IDs (on each model page,
Copy ID) or the URLs of the model pages, or a whole game ("every model of Final Fantasy VII"). - Your contact information: name, postal address, email, and a phone number.
- Good faith: a statement that you believe in good faith that this use isn't authorized by the copyright owner, its agent or the law.
- Accuracy: a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
- Your signature: physical or electronic (your full name typed in the email counts).
Notices under other laws (e.g. the EU's Digital Services Act) are welcome too: the same information is enough.
Counter notice
If you think something was removed by mistake or misidentification (e.g. a model someone else made and that the notice didn't cover), you can send a counter notice. It needs (17 U.S.C. 512(g)(3)):
- Your contact information: name, postal address, email, and a phone number.
- The removed material and where it was on the site (model IDs or URLs).
- A statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification.
- Consent to jurisdiction: of the Federal District Court for the judicial district of your address (or, outside the United States, any judicial district where the operator may be found), and that you'll accept service of process from the person who sent the notice, or their agent.
- Your signature: physical or electronic.
A complete counter notice is forwarded to the person who sent the original notice. The material comes back 10 to 14 business days later, unless they tell me they filed a court action to keep it down.
Repeat notices and false notices
- Repeat notices: the site has no users and no uploads, everything here was added by me. A game whose owner asked for removal isn't added again.
- False notices: knowingly false claims in a notice or counter notice can make the sender liable for damages (17 U.S.C. 512(f)). Please make sure you own the rights, or act for the owner, before sending one.
Removals
- None so far.
